License Terms for End Customers (GTC) between kreativpalette gmbh and You (the Buyer)

Definition

Kreativpalette GmbH exclusively offers digital products based on the following terms of use. The buyer's general terms and conditions are hereby rejected and do not apply to the purchase of our digital products. Information, data, and pricing details on online platforms, in advertisements, brochures, printed materials, and other publications are non-binding and may be changed at any time. The purchase agreement comes into effect upon order confirmation and/or upon the provision of the product for download. If parts of these license terms are deemed invalid, the validity of the remaining provisions remains unaffected. For all business transactions and legal relationships between the customer and kreativpalette gmbh, the law of switzerland exclusively applies, excluding international private law provisions; the application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.

Terms of Use

The products offered by Kreativpalette GmbH are the intellectual property of Kreativpalette GmbH and may be used for private or commercial purposes, but only if the buyer has purchased the offered product directly from Kreativpalette GmbH or an authorized partner webshop.

To use the digital products of Kreativpalette GmbH, the following conditions must be met:

It is permitted to sell rendered images if they are part of an animation, promotional trailer, or similar productions.
It is permitted to use all 3D models (except for specifically excluded elements) as well as all textures and photos for your own rendering project.
It is permitted to publish your renderings on posters, T-shirts, construction signs, or other items.
It is prohibited to sell, transfer, redistribute, or distribute digital products of Kreativpalette GmbH in whole or in part to third parties (even if they are used as components in your projects).
It is prohibited to sell or commercially use renderings featuring specific main motifs (e.g., as a postcard, photo wallpaper, etc.), unless expressly permitted.
It is prohibited to use 3D models of Kreativpalette GmbH for any type of game.

Delivery Terms

All products are delivered exclusively via download. Once the order and payment have been successfully completed, the download link will be provided. You will receive the required password to extract the ZIP file at the email address you provided. The download link remains active indefinitely. To extract the downloaded, compressed ZIP file, you will need appropriate software.

In case of technical or other issues, delivery time may be delayed. If data is defective or missing, please contact us at info@kreativpalette.com.

Disclaimer of Liability

Kreativpalette GmbH assumes no liability for any damages or losses caused by the purchased products, whether directly or indirectly. This includes, but is not limited to, financial losses, data losses, or other damages or penalties. The buyer agrees to keep login credentials and the download link confidential and not to share them with third parties. Please ensure before purchase that the offered data formats are compatible with your software.
